Terms and Conditions for Use of Alaska Mariculture Promotional Assets.
By downloading Alaska Mariculture Alliance (hereafter referred to as AMA) image, graphic, collateral and video assets, you hereby acknowledge and agree to adhere to the terms and conditions for use of the AMA assets as set forth below. These terms and conditions of use constitute a legal agreement between you and AMA.
AMA assets may include, but are not limited to, photographs, video and artwork depicting Alaska’s mariculture industry, Alaska mariculture products, Alaska mariculture farms and farmers, Alaska’s natural beauty, and dishes prepared with Alaska mariculture products. All AMA assets you currently have or obtain in the future are subject to these terms and conditions.
AMA assets may be used only in conjunction with the promotion or sale of Alaska’s mariculture industry or Alaska mariculture products.
Proof of Alaskan origin must be shown promptly upon request.
AMA assets may be resized as necessary for permitted uses but shall not be modified in any other way without AMA’s prior written consent.
AMA may require photo credits for all uses of AMA assets. Photo credits shall read “Photo Courtesy of Alaska Mariculture Alliance.”
The use of AMA assets is subject to further guidelines that AMA may issue from time to time.
Upon request by AMA, you will allow AMA to review and approve in advance all uses of AMA assets on packaging and marketing materials (such as advertisements, collateral materials, POS materials, and video footage).
Permission to use AMA assets as set forth above is a non-exclusive, non-transferable and revocable license, and will renew at the beginning of each calendar year until revoked. AMA will notify you if, in its sole discretion, it does not renew your permission to use AMA assets.
All photos, images, videos, and assets are the property and copyright of AMA. You acknowledge that AMA assets are protected under applicable copyright laws.
AMA reserves the right to remove any images, videos or other assets from its library at any time. If it does so, you may be advised to cease all use of such assets.
Use of photo, image, video, or other assets shall not be used to show or imply AMA endorsement of any commercial or personal product or enterprise or to indicate that AMA concurs with the opinions expressed in, or confirms the accuracy of, any statement or text used in association with the assets.
Images may not be used for editorial purposes.
Images may not be used for political purposes.
These Terms and Conditions will supersede and replace any prior Terms and Conditions between AMA and you regarding use of the AMA assets.
You hereby warrant to AMA that any products you identify or associate with any AMA assets fully comply with all applicable state, federal, local, and international laws and regulations governing the production, promotion, distribution and sale of such products, and you will indemnify, hold harmless, and defend AMA from and against any claim of, or liability for error, omission, negligent act, or any other third party claims arising out of or related in any way to the production, promotion, distribution, sale, or use of your products.
Due to copyright protection, these assets and images may not be shared and/or used by any individual except for that individual named in the photo application via AMA image library. Sharing of the images may result in legal action against both you and the recipient of the images.
AMA and/or the photographer reserves the right to rescind copyright privileges at any time for infringement of use, and/or if the image is sold by the photographer to another party for exclusive use, and/or if the image is used to misrepresent the intention of the photographer.
Use of this website and any assets provided from this site implies that you have read, understand, and accept these terms and conditions.
